1. Purchase general conditions and acceptance

These general conditions of purchase and acceptance regulate the acquisition through our website www.floristeriasnavarro.com

When buying in the store, the client will have an option to consult the General Conditions of the virtual store of Navarroverd.

2. Nature of the virtual store.

The store is focused to final consumers, in the sense established by law 26/1984, of 19th July, general for the defense of the consumers and users, and for the use or own consumption of the client or the people on behalf of the client legally authorized to act. Therefore,  services to wholesalers, distributors, great surfaces and other professional intermediaries are totally excluded.

As stated on the above, it is completely prohibited the resale of products acquired through the virtual store.

Navarroverd reserves the right to modify unilaterally, at any time and without previous warning, the presentation and configuration of the store, as well as to withdraw the temporary or definitive access.

 3. Operative of the virtual store.

3.1. To register itself in the store.

The client who accedes to the store and wants to buy for the first time, will be registered when filling up the form that will appear in the screen at the time of  the purchase. Once submitted he will become a Navarroverd client and he will take part of our Internet clients database.  He will always be able to accede to all the services in the website and other that may appear in a future. Once registered in Navarroverd, you will receive via email the set up proof with all data as well as the purchase receipt. From that moment you will enjoy  the benefits that Navarroverd clients have.. Due to the nature of the product which we sell in our store (flowers and plants to send as a present) it’s very important to have as much information as possible, such as addresses and contact phone numbers so we can solve whatever unforeseen that may appear.The client always can submitt the right to modify or to cancel  his data by sending an email to tienda@floristeriasnavarro.com or calling to the 93.207.07.22

3.2. Product range and price application.

Navarroverd offers a wide an assorted range of flowers, plants and different compositions.  From his computer, the client can acquire them with no need to move. Navarroverd wants to inform  him that the image of products shown in the virtual store may slightly vary once delivered because the plants are not all identical and the bunches are artistic creations. Although the florists make them with a model pattern just as the one that appears in the page Web, not always it will be the same. Nevertheless, Navarroverd  guarantees the quantity of flowers and sizes of the plants as they are shown in the virtual store. The prices of products of the store include the applicable VAT in each case. 21% to fresh flowers, plants and the accessories, and 10% the chocolates Currency shown is always in EUROS.

Navarroverd reserves the right to modify unilaterally, at any time and without previous warning, the prices of exposed products, as well as to suspend its sale or to cancel them definitively  or temporary.

3.3. Purchase.

You will find in our store all the products that are available that day. Every day they are updated and the products exhausted are removed so new ones are added. You will be able to navigate by the menus of the virtual store until arriving at the wished product. Client will possibly find the same in several  sizes or colors to choose. Once he has chosen the product he will have to include it in the shopping cart, being able to add more products to the same cart. He will be able to consult whenever he wants the contents of the cart and remove if something  does not interest  him. In order to finish, he will have to go to "cash" and make the final steps to conclude the purchase. Navarroverd is committed to finish its order of flowers or plants in a maximum term of 4 hours after the order closing by Internet. So its delivery is ready. If the order is made before 6h p.m. it could be delivered the same day, otherwise delivery would be made the day after since all orders received from 6h p.m. are gathered to 8h a.m in the following morning. Min. price 30Eur and 24Eur for Barcelona city.

3.4. Shipment of an order to another area of Spain or worldwide.

In case client wants to send flowers or plants outside the Navarroverd distribution area, it will have to do it through the Interflora service. Client will automatically have access to our other offer of bunches and plants, with their  prices to send to any area of Spain or worldwide. Client will find all the steps to follow to submit the purchase.

3.5. Order preparation and its distribution.

Navarroverd guarantees that all the exposed products are available, although due to its nature, colour, size may vary as well as the quantity .In that case Navarroverd will contact the client to decide any modification.

Depending on the type of purchase, all the orders will be distributed in two forms:

Through Navarroverd available means.
Through the Interflora Service for the rest of the national territory.

In the first case, the client will be able to consult the transport increase that his purchase may suffered. This increase is subject to the transport tables according to the order destination.

In the second case, it will be able to consult the distribution system that it is shown in the same Interflora page and that will vary in each case according to the destination zone.

Navarroverd reserves the right to modify unilaterally, in any case and without previous warning, the transport charges for the distribution of sold products.

3.6. Delivery and return policy.
a) Delivery wherever indicated by the client.

 This option allows delivering the order where the client indicates to us and in the selected hour strip in all those villages within the Navarroverd distribution area. Home delivery service is performed by our own fleet, with the trained staff for  handling flowers and plants. For deliveries outside Navarroverd area,Interflora service will be used so that the delivery will be managed by the nearest selected florist to the choosen destination.Deliveries timetable.

Orders deliveries within Navarroverd area are from 8:00h to 22:00h, every day of the year without exception, including Saturdays and Sundays. Delivery timetable of the orders gathered directly in our store will be of 24h the 365 days of the year. Navarroverd and its virtual store never close. In case you wish a delivery in a specific time you should remark it to us within 3 hrs margin so we can meet your requirement.

In no case Navarroverd will accept a specific delivery time in Special Celebrations. Please check our our showcase "Special Celebrations" for further details.

There is an option of "morning delivery" and " evening delivery" in some special celebrations as indicated in this section. In other "special celebrations" deliveries will be done during the day with no commitment of a specific time from our side. Book whenever it is possible your flowers a day earlier so we can guarantee the best service.

Navarroverd does not assume any responsibility by the delay of an order delivery  when this delay is not attributable directly to him, or for cases of force majeure in the terms and conditions anticipated in point 4, within these general conditions.

Shipment expenses.

Shipment expenses are variable according to order destination. Its total amount will always appear when closing the order in the website.

Returns

In accordance with the provisions of article 45 Law 6/96 dated 15th  January of  the retail commerce, the client will not be able to return to Navarroverd fresh products if this return does not take place within 24h after the delivery or collection of the order.

3.7. Payment methods

Payment can be made  by the following credit or debit cards:

And any card that guarantees the new system of "safe purchase" recently implemented.

We are continuously studying the way to better guarantee the transactions made by Internet by providing the 16 digits of its  payment card.. Navarroverd guarantees the total security of its transactions, since it has the current technological standards as far as protocols and security systems. All the collections take place through the safe “La Caixa” plattform through Cyberpack, with the total guarantee of security referred to his card data as well as his numbering.

Navarroverd never has the numerical display of its card, being”La Caixa” that manages this information and it gives us the "OK”  of each payment.  Soon, the system of "safe purchase" will be mandatory. Each purchase made by Internet will require the security code or password that you only will have to know.  This will avoid anyone else to use your numbering in any fraudulent transaction.

We will implement this new service very soon. Regardless that it will be in the term of 2 years by all banking organizations worldwide such as Europe, Asia, America who have  already established appropiate dates and terms of total implantation.

3.8. Confidentiality and security

Navarroverd maintains a policy of confidentiality of the data provided by
by its clients and it is committed to protect these data from the virtual store. In this sense, Navarroverd guarantees in terms established by Statutory law 15/1999, of 13 of December, of protection of character data personal (LOPD), that will confidentially deal with the database of the client, and that the server where all the information will be stored, provides the necessary safety measures so that nobody can access the database.

However, Navarroverd can reveal, to requirement of the competent authorities, the personal database and any other information that it may have through his computer systems, in accordance with the legal and prescribed dispositions applicable to this case.

In no case, Navarroverd will reveal the content of this information to companies and services of marketing, commercial data bases and third organizations that are dedicated to publicity, lists of massive marketing or activities related to Spam and similars.

4. Greater Force

It is understood by greater force, with declarative but non limited character:
I - Any event impossible to foresee, or that predicted, be inevitable.
II - Errors in the access to the different  Web pages of Navarroverd store.
III - the errors in the provision of the electrical network or telephone.
IV - the damages produced by third or attacks to our Website such as virus, hackers, etc. that may affect the quality of the service and that is not imputable to Navarroverd nor to the end user.
V - the failures in the transmission, diffusion and storage or shipments through third of products contained in the virtual store of Navarroverd.
VI - Fires.
VII- Floods or earthquakes. 
VIII- Strikes or other social disorders that hamper the products supply and therefore, the fulfillment of  Navarroverd obligations.
IX - the shortage or little availability of fuel or electrical energy.
X - Accident.
XI- Armed  conflict.
XII- Commercial Embargos or any other type.
XIII-Frosts or droughts, that do not allow to the correct supply of flowers or plants.
XIV- Any governmental disposition.

5. Applicable law and jurisdiction

These general conditions of Purchase will be interpreted in accordance with the Spanish legislation.

For any litigious question derived from the existence, access, use or content of the general conditions of purchase, as well as the client, as Navarroverd, with express renunciation to any other law that could correspond to them, will be put under the jurisdiction and exclusive competition of the courts of Barcelona.
